תקציר הפעולה:

מהלך הפעולה:

 

שלב א':

מחלקים את כולם לקבוצות קטנות של 5-10 ולכל קבוצה ממנים מנחה.

מקרינים סרטון קצר על נחשון וקסמן, אפשר למצוא אותו באתר או ביו טיוב

באמצע הסרט עוצרים בכתובית "what would you do?"

 

שלב ב':

מחלקים דפי מקורות על פדיון שבויים (מצורף) ומעלים את דילמת ההלכה מול מעשה בעניין פדיון שבויים, מה המקור לזה, מה חושבים רבנים אחרונים בעניין. כל קבוצה פותחת דיון על מה הם היו עושים ומה הכי נכון לעשות במקרה של נחשון וקסמן.

אחר כך ממשיכים את הסרט ומסכמים את הפעולה.

 

שלב ג':

בסוף מחלקים לכל אחד את ההספד של הרב מוטי אלון על נחשון. מומלץ לא לפץוח את ההספד לדיון אבל לאפשר לחניכים המעוניינים בכך לגשת אליכם לאחר מכן ולהביע את דעתם על הפעולה ומה הם הרגישו.

 

מצורף גם דף לנקודות להרחבת הדיון שאפשר לחלק לכל המנחים של הקבוצות.
מצוות פדיון שבויים 
(The Redemption of Captives)

 

The importance of Pidyon Shvuyim is learned from a Gemarah discussing the Mitzvah of Tzdaka:

בבא בתרא ח' ע"ב

"מאי מצווה רבה? א"ל אביי, מדתני רב שמואל בר יהודה: אין פוסקין צדקה על היתומים אפילו לפדיון שבוים, שמע מינה: פדיון שבוים מצווה רבה היא. 

אמר ליה רבא לרבה בר מרי: מנא הא מילתא דאמור רבנן דפדיון שבוים מצווה רבה היא? 

א"ל, דכתיב: (ירמיהו טו) "והיה כי יאמרו אליך אנה נצא ואמרת אליהם כה אמר ה' אשר  למות למות ואשר לחרב לחרב ואשר לרעב לרעב ואשר לשבי לשבי", ואמר רבי יוחנן: כל המאוחר בפסוק  זה קשה מחברו. חרב קשה ממות ...רעב קשה  מחרב ... שבי קשה מכולם, דכולהו איתנהו ביה."  

# What is the Gemara's reason to release Captives?

Rambam adds to this Gemarah and  rules that he who ignores ransoming a captive is guilty of transgressing commandments such as “you shall not hearden your heart” (Deut. 15:7); “you shall not stand idly by the blood of your brother” (Lev. ); and “you shall love your neighbor as yourself” (Lev. ). (Maimonides, Laws of Gifts to the Poor, Yoreh Deah 252:2). And one who delays in ransoming a captive, is considered like a murderer (Yoreh Deah 252:3).

# It would seem from the above, that pidyon shvuyim is an absolute mitzvah, which must be followed at all times. But there is one major exception- what if the price is too high?

משנה גיטין ד' ו':

"אין   פודין את השבויין יתר על כדי דמיהן, מפני תיקון העולם;  ואין מבריחין את השבויין, מפני תיקון העולם; רשב"ג אומר: מפני תקנת השבויין". 

The Gemara explains what is Tikun Olam that because of it we do not release Captives And what does the restriction "Yeter ad kdei Dmeihen" (more than their value) mean.

גמרא גיטין מ"ה ע"א:

"איבעיא להו: האי מפני תיקון העולם - משום דוחקא דצבורא הוא (אי אפשר לחייב את הציבור להגיע לידי עניות בשל כספי הפדיון ), או דילמא משום דלא לגרבו ולייתו טפי (או שמא יש להגביל את הרצון לפדות שבויים במחיר גבוה כדי שלא ייווצר מצב שיחטפו עוד יהודיים)

# What are the two explanations the Gemarah gives to the restriction of Tikun Olam?

Back to our dilemma…

Rabbi Goren and many rabbis compare our dilemma to the Mishnah and say that hundreds or thousands of terrorists is an excessive price to pay for a few Israeli soldiers. This type of exchange will endanger the public by increasing kidnapping and setting loose thousands of terrorists. More then that- Israel should not redeem captives at any price. If terrorists know that they will always be freed, Israel loses its power of deterrence.

On the other hand Rabbi Hayyim David Halevi says that the Mishnah in Gittin is not really relevant to our dilemma because at that time robbers kidnapped for money, while Palestinian terrorists kidnap for nationalistic reasons and the price we pay will not stop their attempts to kidnap. More then that- Israel has a moral obligation to do whatever it takes to redeem its citizens.

So what would you do?

Arguments in Favor of the Current Exchange

  1. Israel has a moral obligation to do whatever it takes to redeem its citizens.

  2. Nachshon Wachsman has been tortured and is sick. We must save him now, because he is in immediate danger.

  3. Israel must do everything it can to redeem captives like Wachsman because if not, our soldiers will retreat in battle rather than risk capture.

  4. Most of the terrorists to be released do not have “blood on their hands”.

 Arguments against the Current Exchange

  1. Israel should not redeem captives at any price. If terrorists know that they will always be freed, Israel loses its power of deterrence.

  2. Exchanging hundreds of terrorists for one Israeli encourages future kidnappings of Israelis.

  3. There is no such thing as a “harmless” terrorist. Many of the terrorists released returned to terror. A number of recent suicide bombings were carried out by terrorists released in previous exchanges and amnesties.

  4. This exchange will give Hamas tremendous prestige and help revive a deadly terrorist organization.

  5. the public takes precedence over the individual, even if this endangers the individual. Exchanging hundreds or thousands of terrorists for one Israeli encourages kidnapping of Israelis, and frees hundreds or thousands of terrorists who will pick up their weapons and attack Israel. In other words, it endangers the public.

Arguments in favor of an Israeli military action to save Nachshon Wachsman

  1. Israel intelligence knew exactly where Nachshon was being held and could plan an action to try and save him.                                                                                                                                                

  2. An attack against Hamas will show them Israel is not afraid of them and will not follow terrorists terms.

  3. The moral of the soldiers in the army will grow knowing that Israel will do everything they can to redeem them if they get caught.

Arguments against an Israeli military action to save Nachshon Wachsman

  1. Why risk many more soldiers for the chance of saving one?

  2. Israel already has a bad name in the world for fighting when they can get to an    agreement, this will increase world hatred.
